The Court of Appeal on Friday voided the judgment of the High Court of the Federal Capital Territory that sacked the Executive Council of the Peoples Democratic Party in Anambra State.
The appellate court upheld the separate appeals that were brought before it by the PDP and Uchenna Obiora respectively.
In the separate appeals, the court held that the trial court lacked jurisdiction to hear the suit bordering on the leadership of the party.
At the trial court, Justice Olukayode Adeniyi had made an order sacking the Anambra PDP Excos.
In the suit marked HC/CV/774/2021, Samuel Anyakolah had brought the suit for himself and on behalf of all the local government chairmen and ward executives that emerged from the Anambra PDP Congress conducted on November 28 and December 1, 2020.
The PDP, Ndubuisi Nwobu, and Uchenna Obiora were the defendants in the suit.
